1. About These Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at https://povia.store and any related pages, content, features, and online services that link to these Terms (collectively, the “Website”), as well as your purchase of products through the Website.
The Website and the Povia brand are operated by 小夜貓商行, a sole proprietorship registered in Taiwan under Taiwan Unified Business Number (Tax ID) 00690135, using the English trade name Nightcat Studio (“Povia,” “Nightcat Studio,” “we,” “us,” or “our”). “Povia” is a brand and storefront name and is not a separate legal entity.
By accessing or using the Website, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Website or place an order.
Your purchases and use of the Website are also subject to our:
- Privacy Policy;
- Shipping Policy;
- Return & Refund Policy;
- Limited Warranty, if applicable to the product;
- Subscription Policy, if you enroll in a recurring service; and
- any product-specific terms, disclosures, instructions, or notices shown on the applicable product page or at checkout.
These policies and product-specific terms are incorporated into these Terms by reference. If there is a conflict, mandatory applicable law will control first, followed by the product-specific offer presented and accepted at checkout, the applicable separate policy, and then these Terms.
2. Eligibility
You may use the Website and place an order only if you are legally capable of entering into a binding contract under the laws that apply to you. If you have not reached the age of majority where you live, you may use the Website only with the involvement and consent of a parent or legal guardian.
By placing an order on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
We may limit the countries, regions, persons, or addresses to which we sell or ship products. Available sales and shipping destinations will be shown on the Website or at checkout.
3. Website Accounts
Certain Website features may require an account. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for safeguarding your login credentials and for activity conducted through your account. Notify us promptly at support@povia.store if you believe your account has been accessed without authorization.
We may suspend or terminate an account if we reasonably believe it is being used fraudulently, unlawfully, in breach of these Terms, or in a manner that threatens the security or operation of the Website.
4. Website Use
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for personal, lawful shopping and informational purposes.
You may not:
- use the Website or our products for an unlawful, fraudulent, abusive, or unauthorized purpose;
- interfere with the Website, its servers, networks, security features, or other users;
- introduce malware, malicious code, automated attacks, or harmful technology;
- scrape, crawl, harvest, or systematically extract Website content or personal information without our written permission, except as permitted by applicable law;
- impersonate another person or provide false or misleading information;
- infringe our rights or the rights of another person, including intellectual property, privacy, publicity, or contractual rights;
- use the Website to transmit unlawful, threatening, defamatory, obscene, or abusive material; or
- attempt to bypass purchase limits, access restrictions, fraud controls, or other safeguards.
5. Product Information and Availability
We aim to describe and display our products accurately. Minor differences in color, appearance, packaging, or presentation may occur because of screen settings, production changes, or updated packaging. Such differences do not permit us to provide materially inaccurate descriptions of a product’s functions, specifications, compatibility, or included components.
Product specifications, prices, availability, and included accessories may change before an order is accepted. Changes will not retroactively alter an order already accepted by us unless you agree or the change is required by law.
All products are subject to availability. We may limit quantities, discontinue products, or decline orders intended for unauthorized resale. Purchase limits may apply per person, household, account, payment method, billing address, or shipping address.
If we discover a material error in a product description, price, promotion, compatibility statement, or availability before accepting or shipping an order, we may contact you for instructions or cancel the affected order. If we cancel an order after payment has been collected, we will refund the amount charged for the canceled item, including any associated amount that applicable law requires us to refund.
6. Connected Cameras, Apps, and Network-Dependent Features
Some Povia products may depend on Wi-Fi, cellular service, a SIM card, a mobile application, cloud infrastructure, third-party servers, push-notification services, or other services outside the physical product.
6.1 Wi-Fi and Cellular Models
Wi-Fi and cellular/4G models have different technical and service requirements. You are responsible for selecting the correct model after reviewing the product page, compatibility information, and setup requirements.
For cellular products, availability of cellular coverage in a general area does not guarantee reliable service at a specific installation location. Compatibility and performance may depend on the product’s supported frequency bands, the selected carrier and plan, local network conditions, signal strength, congestion, terrain, buildings, antenna placement, and carrier policies.
Any carrier, ZIP-code, or coverage check we provide is an informational compatibility aid based on the information available to us. Unless we expressly state otherwise in writing, it is not a guarantee of indoor or outdoor signal strength, carrier acceptance, or uninterrupted service at a specific location.
6.2 SIM Cards and Data Plans
The product page or checkout will state whether a SIM card or data plan is included. Unless expressly stated as included, you are responsible for obtaining and maintaining any compatible SIM card, carrier account, data plan, activation, and related charges required to use cellular features.
Third-party carrier terms, eligibility requirements, usage limits, roaming restrictions, and charges may apply. We do not control a carrier’s coverage, network changes, suspension, throttling, pricing, or discontinuation of service.
6.3 Apps, Cloud Services, and Notifications
Certain features may require a third-party app or service and may be subject to that provider’s terms and privacy policy. The applicable provider and requirements should be identified on the product page, packaging, instructions, or setup screen.
Live viewing, recordings, cloud access, alerts, and push notifications may be delayed, interrupted, incomplete, or unavailable because of internet outages, weak signal, device settings, battery level, server maintenance, mobile operating-system restrictions, third-party service failures, or other conditions.
You are responsible for maintaining compatible devices, supported software versions, secure passwords, and reasonable account-security practices. You should install firmware and app updates when made available and review device permissions and security settings.
6.4 Solar Charging and Battery Performance
Solar charging and battery life vary according to installation angle, sunlight, shade, weather, temperature, battery age, cellular or Wi-Fi signal strength, recording duration, detection frequency, live-view usage, upload activity, and other conditions. Estimated battery life or solar performance is not a guarantee of identical performance in every location or use pattern.
6.5 No Emergency or Guaranteed Security Service
Unless a product is expressly marketed and contracted as such, Povia products are not professional alarm-monitoring services, emergency communication systems, fire or life-safety systems, or substitutes for appropriate locks, lighting, insurance, supervision, emergency services, or professional security measures.
No camera or notification system can guarantee that every event will be detected, recorded, transmitted, or viewed, or that crime, trespass, injury, or property loss will be prevented.
7. Orders and Contract Formation
Your submission of an order is an offer to purchase the products listed in the order. An automated order-confirmation email acknowledges receipt of your order but does not necessarily mean that we have accepted it.
Unless applicable law requires otherwise, we accept an order when we send a shipment confirmation, expressly confirm acceptance, or otherwise begin fulfilling the order. We may decline or cancel an order before acceptance for reasons including product unavailability, pricing or description errors, suspected fraud, payment failure, sanctions or legal restrictions, shipping limitations, purchase-limit violations, or unauthorized resale.
We will use reasonable efforts to notify you if we decline, modify, or cancel an order. If we cancel a paid order, we will issue the required refund to the original payment method. The time it takes for the refund to appear may depend on the payment provider or financial institution.
You are responsible for reviewing your order, selected model, quantity, compatibility, billing information, and shipping address before submitting payment. Contact us promptly if you identify an error. We cannot guarantee that an order can be changed or canceled after processing or shipment has begun.
8. Prices, Currency, Taxes, and Import Charges
Prices are shown in the currency displayed on the Website, typically U.S. dollars unless otherwise stated. Your bank, card issuer, payment provider, or currency-conversion provider may charge separate conversion or international transaction fees that we do not control.
Product prices may change before an order is accepted. The price applicable to an accepted order is the price displayed and agreed to at checkout, subject to correction of obvious errors as described in these Terms.
Shipping charges, sales tax, value-added tax, customs duties, import fees, brokerage charges, or similar amounts may apply. Amounts collected by us will be shown at checkout where reasonably practicable. If checkout or the applicable Shipping Policy clearly states that duties or import charges are not included, you may be responsible for paying them to the appropriate authority or carrier.
Promotions and discount codes are subject to their stated eligibility, duration, exclusions, and purchase limits. Unless expressly allowed, promotions may not be combined, transferred, redeemed for cash, or applied retroactively.
9. Payment
We use third-party payment providers to process transactions. Available payment methods will be displayed at checkout and may vary by location.
By submitting payment information, you represent that:
- you are authorized to use the selected payment method;
- the billing information you provide is accurate; and
- you authorize us and our payment providers to charge the total amount shown at checkout, including applicable taxes, shipping, and other disclosed charges.
Payment authorization does not guarantee order acceptance. If a payment is reversed, rejected, disputed, or identified as unauthorized, we may suspend fulfillment, cancel the order, or seek payment of amounts legitimately owed, subject to applicable law.
Installment, buy-now-pay-later, wallet, or financing services, if offered, are provided under the separate terms of the applicable provider. Eligibility, interest, fees, payment schedules, and credit decisions are controlled by that provider.
10. Shipping and Delivery
Shipping destinations, processing times, estimated delivery windows, charges, carriers, tracking, customs information, address-change rules, and procedures for delayed, lost, damaged, or undeliverable packages are described in our Shipping Policy.
Delivery dates are estimates unless expressly stated as guaranteed. We will use a reasonable basis for advertised shipping and delivery representations. If we cannot ship within a promised period or a period required by applicable law, we will provide any legally required notice and available options, which may include consenting to a delay or canceling the affected unshipped order for a refund.
Risk of loss and title transfer as provided by applicable law and the Shipping Policy. Nothing in these Terms transfers risk to you earlier than applicable consumer law allows.
You are responsible for providing a complete and accurate deliverable address. If you request redirection after shipment, refuse delivery, or provide an incorrect address, additional costs or delivery failures may result. This does not limit your rights where the problem was caused by us or the carrier for whom we are legally responsible.
11. Returns, Refunds, and Exchanges
Eligibility periods, product-condition requirements, exclusions, authorization procedures, return addresses, shipping responsibilities, inspection, exchanges, and refund timing are set out in our Return & Refund Policy.
Any voluntary return period will be calculated from delivery unless the Return & Refund Policy clearly provides a more favorable rule. Defective, damaged, incorrect, missing, or materially misdescribed products may be subject to additional rights and remedies under applicable law and our Limited Warranty.
Do not send a return to an address that has not been confirmed for that return. Contact us and follow the return instructions in the Return & Refund Policy before shipping an item.
Refunds are generally issued to the original payment method unless applicable law requires or permits another method and you agree to it.
12. Limited Warranty and Statutory Rights
Any written product warranty we offer is described in the applicable Limited Warranty or product documentation made available before purchase. Warranty coverage, duration, exclusions, claim procedures, and remedies may vary by product and region.
Except where prohibited by law, warranty coverage may exclude damage caused by misuse, unauthorized modification, improper installation, incompatible power supplies or accessories, accident, abuse, neglect, environmental conditions outside stated operating limits, ordinary wear, or failure to follow instructions. Warranty exclusions will not apply to the extent the alleged condition was not caused by the excluded event or the exclusion is prohibited by law.
These Terms do not exclude, restrict, or modify any warranty, guarantee, remedy, or consumer right that cannot lawfully be excluded or restricted. Where applicable law provides mandatory rights, those rights apply in addition to any voluntary warranty we provide.
13. Subscriptions and Recurring Charges
Purchasing a physical product does not, by itself, authorize us to enroll you in a paid recurring subscription.
If we offer a cloud-storage plan, data plan, monitoring feature, or other recurring service, we will disclose the material subscription terms before obtaining your consent, including the price, billing frequency, trial or promotional period, renewal method, and how to cancel. We will obtain the consent required by applicable law before charging a recurring fee.
Subscription services, if any, are also governed by the offer shown at enrollment and our Subscription Policy. Cancellation will stop future renewals but ordinarily will not retroactively refund charges already earned, except as stated in the applicable offer or required by law.
Charges imposed directly by a third-party carrier, app provider, cloud provider, or other service are governed by your agreement with that provider unless we expressly collect and bill those charges ourselves.
14. Installation and Lawful Use of Camera Products
You are responsible for installing and using camera products safely and in accordance with the instructions, stated operating conditions, and laws applicable at the installation location.
Depending on the jurisdiction and circumstances, laws may regulate video surveillance, audio recording, notices, consent, employee monitoring, viewing of neighboring or public areas, data retention, and disclosure of recordings. You must obtain any notices, permissions, or consents required for your use.
You may not use our products to stalk, harass, discriminate, invade privacy, secretly record where prohibited, facilitate unlawful surveillance, violate another person’s rights, or engage in any illegal activity.
Where installation involves height, electrical work, drilling, structural attachment, weather sealing, or other hazards, use suitable safety precautions and qualified assistance where appropriate.
15. Privacy and Data
Our collection and processing of personal information through the Website are described in our Privacy Policy.
Camera footage, audio, device identifiers, location-related information, account information, and usage data may also be processed by the app, cloud, carrier, or technology provider used with a product. The responsible provider and its privacy terms may differ from the Website operator. Review the applicable app permissions, in-product notices, and third-party privacy policy before activation.
Do not upload, transmit, or share recordings through our services unless you have the legal right to do so. You remain responsible for the content you control and for configuring access permissions appropriately.
16. Third-Party Services and Links
The Website and products may interact with third-party payment processors, carriers, logistics providers, app stores, applications, cloud services, cellular networks, mapping services, analytics providers, social networks, or external websites.
We do not control third-party services and are not responsible for their independent acts, content, terms, privacy practices, changes, outages, or discontinuation, except to the extent applicable law makes us responsible or we have expressly undertaken that responsibility.
References or links to third parties do not necessarily constitute endorsement. You should review the terms and policies applicable to third-party services before using them.
17. Intellectual Property
The Website and its content—including text, graphics, logos, trademarks, photographs, videos, layouts, software, and compilations—are owned by us, licensed to us, or otherwise used with authorization and are protected by applicable intellectual-property laws.
Except as expressly permitted by law or in writing by us, you may not reproduce, distribute, publicly display, modify, create derivative works from, sell, license, or commercially exploit Website content.
Names and logos belonging to third parties remain the property of their respective owners.
18. Reviews, Feedback, and User Content
If you voluntarily submit a review, photograph, video, feedback, question, or other content to us or through the Website (“User Content”), you retain ownership of your original content.

You represent that you have the necessary rights to submit the User Content and that it is not unlawful, misleading, defamatory, infringing, or privacy-invasive.
We may moderate or remove User Content that violates these Terms, is fraudulent, contains malware or personal information, infringes rights, is unrelated spam, or is otherwise unlawful. We will not prohibit, penalize, or remove a review merely because it expresses an honest negative opinion, and we will not materially alter a customer’s review in a way that misrepresents the customer’s views.
19. Website Availability and Changes
We may maintain, update, modify, suspend, or discontinue Website features or services. We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
Changes to the Website will not eliminate rights or obligations relating to an order already accepted, a warranty already provided, or a subscription already paid for, except as permitted by the applicable agreement and law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS ONLINE FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES REGARDING THE UNINTERRUPTED OR ERROR-FREE OPERATION OF THE WEBSITE, EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED.
PRODUCTS ARE SUBJECT TO THEIR EXPRESS DESCRIPTIONS, ANY APPLICABLE LIMITED WARRANTY, AND NON-WAIVABLE STATUTORY RIGHTS. NOTHING IN THIS SECTION DISCLAIMS AN EXPRESS WRITTEN WARRANTY WE HAVE PROVIDED OR LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

21. Limitation of Liability

22. Indemnification

23. Force Majeure
We will not be liable for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, fire, epidemic, war, civil unrest, government action, sanctions, labor disputes, transportation interruption, carrier failure, utility or telecommunications outage, cyberattack, or supplier disruption.
This section does not excuse obligations that applicable law requires us to perform, including required notices, refunds, or protections relating to unshipped consumer orders.
24. Suspension and Termination
You may stop using the Website at any time.
We may suspend or terminate access to the Website or an account if you materially breach these Terms, use the Website unlawfully or fraudulently, threaten security or other users, or fail to pay amounts properly due.
Termination does not affect rights and obligations accrued before termination, including payment obligations, accepted orders, returns, warranty claims, ownership provisions, liability provisions, dispute terms, and other provisions that by their nature should survive.
25. Changes to These Terms
We may update these Terms to reflect changes in our business, products, services, technology, or legal obligations. The revised Terms will state a new “Last Updated” date.
Unless applicable law or the nature of the change requires additional notice or consent, revised Terms apply prospectively when posted. Material changes will not retroactively alter an order already accepted or a paid subscription period already begun without your agreement, except where required by law.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree, you should stop using the Website.
26. Governing Law and Disputes
These Terms and any dispute between you and us are governed by the laws of Taiwan (Republic of China), without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection law or jurisdictional right that applies to you, the Taipei District Court will have jurisdiction as the court of first instance.
Before filing a formal claim, you and we agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and providing a description of the issue and requested resolution. This informal process does not prevent either party from seeking urgent relief or using a consumer-protection or dispute process that cannot lawfully be restricted.
Nothing in these Terms deprives a consumer of mandatory rights or remedies available under the law of the consumer’s habitual residence where those rights cannot lawfully be waived by contract.
27. General Provisions
27.1 Entire Agreement
These Terms, the policies incorporated by reference, the applicable product page, and the terms accepted at checkout form the agreement between you and us regarding the Website and your purchase.
27.2 Severability
If any provision is held unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted or modified as necessary, and the remaining provisions will remain in effect.
27.3 No Waiver
Failure to enforce a provision is not a waiver of that provision or any other right.
27.4 Assignment
